Sheriff Sues Former Police Chief, Police Organization

EDGEFIELD – Edgefield County Sheriff Adell Dobey has
filed a civil lawsuit naming former Johnston Police Chief Lelex “Butch”
Easler and the Palmetto Police Benevolent Association, Inc. (PBA), as
co-defendants. The suit, filed on July 14, levels seven causes of
action against both defendants including abuse of process, civil
conspiracy, defamation, and fraud among other actions.
According to the suit, it is alleged that Easler was a sitting
“officer” on the local PBA board and used his influence with the board
to secure funding for his lawsuit filed
in May of 2008 naming the Town of Johnston, Johnston Town
Councilman Thomas “Tommy” Burton, Edgefield County Sheriff Adell Dobey,
and the Edgefield County Sheriff’s Office as defendants.
The suit claims that Sheriff Dobey, who was also a member in good
standing with the PBA before being elected Sheriff and was a member
during the time period of Easler’s suit, was not afforded the same
support the PBA it provided to former Chief Easler. The suit also
alleges that, “The Defendant PBA and its agents conspired with the
Defendant Easler, and other individuals, for the purpose of injuring
the Plaintiff (Dobey).”
Such injury included making false statements with the intention of
harming Sheriff Dobey, his positions as sheriff, and to create a
“hostile work environment” within the ranks of his deputy sheriff’s,
the suit states.
The suit claims that, “the Defendant Lelex Easler, has with actual
malice, made libelous comments to others regarding the Plaintiff’s
fitness to be Sheriff, and such comments were made with knowledge of
their falsity, or with reckless disregard for their truth and veracity.”
One of the many cause of actions listed regarding fraud, the suit
claims that Sheriff Dobey was paying dues to the PBA that were in turn
used to support a cause of action against him. “That as a result, the
Plaintiff was consequentially and proximately injured by the
fraudulence, and falsity, of the PBA’s claims.”
“That the Defendant PBA failed to monitor for conflicts of interests
between fellow members and provided financial backing to the Defendant
Easler without affording the same opportunity to the Plaintiff (Dobey).”
The ten page suit was filed on behalf of Sheriff Dobey by local
attorney Randall DeWitt Williams of Edgefield, in the Court of Common
Pleas and seeks a jury trial. The case number is 2010-CP-19-00265 and
represents only one side of the lawsuit.
The defendants have thirty days to respond to the allegations.
Sheriff Adell Dobey was unable to be reached for comment due to missed
returned phone calls by Sheriff Dobey seeking a comment.
Former Police Chief Lelex “Butch” Easler said he was unaware of the
suit and had not been served at this writing. “I haven’t seen it so I
don’t have any comment,” he said.
The suit filed by Easler remains unresolved at this time. That case is
Civil Action No. 08 CP-19-166.
